ATLANTA (AP) — A lawyer for the family of a man who died while in East Point police custody says he has filed a wrongful death lawsuit against the officers and city.
The lawsuit filed Thursday says former East Point police Sgt. Marcus Eberhart and former Cpl. Howard Weems used excessive force against Gregory Towns Jr. in April. The lawsuit says officers used the stun gun against him 13 times while he was handcuffed.
The lawsuit was filed on behalf of Towns' infant son and estate by Towns' mother, who is the administrator of his estate, and by the mother of his son.
Eberhart couldn't immediately be reached for comment. Weems' lawyer and the city's attorney declined to comment. The lawsuit says the officers no longer work for the department.
